The Norsk Risktoto is in charge of monitoring and regulating pari-mutuel betting, aka horse racing. This also includes accepting horse race wagers over the internet. Norsk Tipping is the national lottery. The Gaming Act of 1992 gave Norsk Tipping a monopoly-like control over the country’s lottery and sports betting operations, which was later followed by also adding the exclusive right to host online poker websites.

Three legal acts were introduced in Norway in the 20th century and these further clarified the exceptions from the strict ban on gambling. These were the Totalisator Act of 1927, the Gaming Act of 1992 and the Lottery Act of 1995. There is also a supervising body in Norway for all legally present gambling operations including lotteries, slot machines, horse race betting and sports betting, raffles, bingo and online gambling – the Norwegian Gaming Authority.

Lotteri-og Stiftelsestilsynet announced newly proposed regulatory reforms in 2020. The Norwegian government said it would impose stricter sanctions against unlicensed gambling operators and affiliates which promote them.

A new Gaming Scheme Act unifies the Lottery Act, the Totalisator Act, and the Gaming Scheme Act. The new regulation that replaces these three existing acts was introduced to the Norwegian parliament in June 2021 and was processed by the Family and Cultural Affairs Committee. Although the Gambling Act consolidates the rules from the previous three acts, it also delivers a few additional regulations.

The new Gambling act introduces so-called “infringement fees” for operators that don’t comply with the new regulations. Operators who target the Norwegian market without a valid license will also pay these fees. The new law allows Lotteri-og Stiftelsestilsynet to charge operators up to 10% of the turnover if they brake the rules. One of the introduced measures also includes a ban on TV ads that are broadcasted from abroad. However, the Gambling act still maintains the market monopoly of Norsk Rikstoto and Norsk Tipping.

Time and betting limits are topics of speculation. As it stands, the situation in Norway sees 66% of online gambling activity taking place on international websites. Bettors seem to be moving away from the state monopoly and closer to international operators, which offer them better game variety and better “prices” in comparison to the domestic system.

However, the new law targets operators without a Norwegian gambling licence. The government said that Gambling Act would sanction foreign gambling companies not complying with Norwegian laws. Therefore, the new act will enable the Norwegian Lotteries Authority to use additional tools to detect and punish iGaming brands violating the law. Moreover, all operators must have accountability measures in place. Finally, any marketing activity towards self-excluded gamers would be a criminal offence.

The new regulation should come into effect on January 1st, 2023, if approved. The law was criticized by Norsk Bransjeforening for Onlinespill/NBO (the Norwegian Industry Association for Online Gaming). NBO is against the monopoly and endorses a new licensing model for private gambling operators.

Are You Required to Pay Taxes on Winnings?
