Laws and Regulations on Online Gambling in Peru?

Regulation icon

According to many, Peru has one of the best gambling regulatory systems in all of South America, if not the world. Instead of outright prohibiting online casinos, the DGJCMT chose to give Peruvian players the freedom of choice. However, not everything is sunshine and rainbows in the Land of the Inka. Let’s take a look at laws and regulations on online Gambling in Peru – both historically and currently.

Evolution

The beginnings of legal casinos in Peru can be traced back to 1979. Then, Congress passed a law allowing slots to be installed in hotels. Even though they didn’t actually legalize land-based casinos, the state showed its true intentions through this ‘pilot project.’ And since Peruvians have always been crazy about gambling, the population wanted even more liberal regulations.

Thus, in 1991, the situation was further consolidated, and in February, the first actual gambling venue was opened in Lima. Unfortunately, 1992 brought forth new legislation, along with a significant tax hike – venue owners were now forced to pay 20% of their net profits in taxes, compared to the 3% requirement that existed before.

Expectedly, this sparked a wave of revolt and dissatisfaction. This, in turn, led to a long-standing legal battle, which only ended in the Constitutional Court in 2006. The players ultimately won, forcing the government to change the law once again.

However, new technologies were looming, and Peru didn’t want to be left behind once again. In 2008, Congress officially legalized online gambling and started giving out licenses. Betsson was the first licensee, but even great news like this couldn’t distract players from one big problem – a lack of regulation. Something had to change.

Current State

Despite Peru being ahead of the rest in terms of iGaming regulations, nobody was truly happy. Everyone knew that Congress had to pass a new law sooner or later, whether it was the players, the operators or the government.

Thus, Bill 31557 came into existence in mid-2022. Throughout the summer, many drafts were suggested. Congress rejected most of them, mainly due to player taxation and other financial issues. However, November 2022 saw MINCETUR finally release the bill.

It defined online casinos and gave DGJCMT the duty to hand out licenses to any interested applicants. Overall, this was seen as a victory by all sides, mainly by the players. They loved that offshore casinos remained legal, further expanding the market. In addition, foreign operators are exempt from paying taxes as long as they don’t have an official Peruvian branch.

Are You Required to Pay Taxes on Winnings?

Taxes icon

No, you are not required to pay taxes on winnings from online casinos in Peru. However, this wasn’t always the case, as the Peruvian Tax Code defined this as taxable income. It was 30% for a long time, discouraging players from playing and companies from applying for a license. This rate was amended multiple times since its enactment until it was completely scratched.

The situation was quite uncertain until August 12, 2022, when Congress passed Law No. 31557. It officially absolved both Peruvians and foreigners from paying taxes on their winnings. But it wasn’t all smooth sailing, as some initial drafts included a 1% Selective Consumption Tax (IFC). Fortunately, these suggestions were scratched pretty early on.

As it stands, only operators are taxed by the Superintendencia Nacional de Aduanas y de Administración Tributaria (SUNAT), with the following conditions and rules:

  • All taxes are to be paid monthly, with fines and permanent or temporary banishment as possible punishments.
  • The total tax rate is 12% and is calculated as all income, excluding maintenance expenses (~2%), payouts and previous tax payments (they’re a deductible expense, according to SUNAT)
  • Collected taxes will be distributed as follows: 40% will go to tourism development, 20% to mental health organizations, 20% to sports development projects and 20% to the Public Treasury of Peru.

Nevertheless, there are still some uncertainties surrounding the new law. It also proposed an excise tax on foreign brands that have a registered branch in Peru. Not only is the exact tax rate still unknown, but it won’t involve any online casino that doesn’t have a Peruvian subsidiary.

Various groups, such as the Peruvian Sports Betting Association (APADELA), have criticized this part, claiming it gives an unfair advantage to offshore casinos and betting sites. On the other hand, players welcomed this level of freedom and thought it’ll raise the domestic iGaming market.

Can Casinos That Accept Peruvian Players Be Trusted?

Handshaking icon

According to our research and subsequent findings, you can most definitely trust online casinos in Peru. However, the new law still hasn’t been put into practice fully, so you’ll have to take some precautions before you play. If a site is licensed by the DGJCMT, then you have nothing to worry about. The operator passed all the necessary checks, and the regulator will assist in case of a dispute.

Offshore casinos work a bit differently, though. You’re legally allowed to access sites based abroad, but you aren’t entitled to protection from the DGJCMT. Instead, you need to ensure that the site has a strong license, airtight security and fair conditions. To find what you’re looking for more quickly, check the CBM top list and pick one of our recommended brands.

Best Casino Bonuses for Peruvian Players

The best way to utilize Peruvian online casinos is to play with a bonus. Not only will you have a much ‘lighter’ financial burden, but you’ll also get to try out new games, test the site and see what features it has. After a long testing period, our team of experts determined that these are the best casino bonuses for Peruvian players. Enjoy!

Local Payment Methods to Consider

Peru banking icons

When someone asks, ‘what are the best casino banking methods in Peru?’ it’s hard to give a straight answer. If it were some smaller market, we’d have one or two contenders. Peruvians, though, are lucky. There are plenty of local and regional options, making it difficult to choose. However, these deposit & withdrawal methods have proven to be the best at Peruvian online casinos:

  • PagoEfectivo. When looking to deposit at PagoEfectivo casinos, the site will automatically generate a CIP code. Once you get the code, you can either make a cash deposit at a retail store/bank or use your online banking account. Keep in mind that payments have an expiry date for security purposes. If the deadline passes, you’ll need a new CIP code. All things considered, this is an easy and versatile way to play casino games in Peru.
  • Yape. With this interbank service/eWallet, you can send money by scanning a QR code or entering the recipient’s phone number. To register, you need a phone, a card from a participating bank, and a DNI. Unlike KasNet and Tambo, Yape payments can be completed 24 hours daily and are generally much faster than traditional cards or other banking methods.
  • KasNet. Founded by GloboKas, this payment option is actually a network of agents. Think of it as Western Union, but uniquely Peruvian and much more efficient. They have over 13,000 agents within Peru, all of which allow you to pay bills, mortgages, and take care of your other daily needs. To deposit at KasNet casinos, follow the instructions on the site and visit your nearest KasNet agent to complete the transaction.
  • Tambo. Believe it or not, this convenience store chain doubles as a casino banking method. It works exactly like KasNet – you select Tambo in the site’s Banking section, follow the instructions and stop by your nearest Tambo stores. The cashier will guide you through the process, while the casino will notify you once the transfer is cleared.

Depositing with PEN Currency

Peruvian Sol symbol

Also known as the Nuevo Sol, the Peruvian sol is accepted by almost all Peruvian online casinos. Contrary to popular belief, Peru is a massive online gambling market, which is why even big brands make sure they accept PEN deposits. In addition, the country’s lax gambling laws have resulted in many offshore sites, including the sol in their list of currencies.

There might be situations where you won’t be able to use sol for whatever reason. In that case, consider the following two solutions:

  • Look for another casino. If you want to play without stressing, pick one of CBM’s recommended sites that accept sol.
  • Find the best exchange rate. Sometimes, casinos will try to pull a sneaky one and offer an exchange rate lower than the actual spread. If you really must deposit with USD or crypto, make sure you’re getting the best deal possible.

Otherwise, the process is pretty straightforward. Casinos that accept Yape or PagoEfectivo also accept PEN deposits, so you’re good to go.

Top Land-Based Casinos in Peru

Land-Based Casino icon

Online casinos in Peru are more immersive than ever; there’s no doubt about it. However, we all know that’s not the whole story. To get a true sense of Peruvian gambling culture, you must dress up and visit a brick-and-mortar casino.

Not only do you have a lot of venues to choose from, but they also offer many of the same features, such as casinos in Vegas or Macau. With a Peruvian twist, of course.

So if you have some time on your hands, grab a few friends and choose one of CBM’s top land-based casinos in Peru. All you need to do is get a drink, say ‘Upyaykurikuy!’ and play responsibly.

Atlantic City Casino

One of the largest land-based casinos in Peru, Atlantic City is open 24/7 and is a must-visit for any traveler or avid gambler. They have over 3000 m2 of gaming space, most of which is devoted to slots. There are around 1000 machines in total, but the real crown jewel of the venue is its private poker room.

It holds high-stakes tournaments throughout the year, making it one of the most notable poker venues in South America. The minimum age required to enter is 18. Whilst playing, you can enjoy free drinks and snacks, but when you’re done, you can count on Atlantic City Casino’s taxi service to take you home safely.

Majestic Casino

Another gem in Lima, Majestic Casino offers a luxurious but unique experience. For instance, they’re one of the only venues in Peru that accept US dollars. The best part about this casino is its stunning collection of table games. At just 20 or so tables, you can play Texas Hold’em, blackjack, roulette, craps, Caribbean poker and more.

However, visitors also enjoy the VIP room, which features punto banco, roulette and more poker tables. Accommodation-wise, you don’t have to worry, as the venue is located within the JW Marriott Hotel. In addition to the gaming area, you can also take a break and enjoy the bar, restaurant or a weekend music performance.

Casino New York

If you find yourself near Chavez International Airport, you must visit Casino New York. Even though the exterior is extravagant, the interior is a bit more low-key. Players can sit at one of the 500 or so slots or give one of the video gaming a try. Overall, there’s a surprising number of variants here.

Aside from classic blackjack and baccarat variants, you’ll also experience Crazy 4 Poker, Blackjack Switch, Texas Bonus Poker and Midi Punto Banco. And just like its name suggests, Casino New York also accepts USD. The staff is very polite and helpful, reminding you of the many ongoing raffles and promos.

Casino La Hacienda Newport

What we love about the casino overall is its clever use of space. Despite not having the biggest gaming area, La Hacienda makes work of what it has and still manages to make it at least somewhat spacious. Not too long ago, they operated from within the La Hacienda Hotel, so seeing what they’ve done with the new location is terrific.

You have access to around 400 slots, many of which are progressive jackpots, which isn’t so common in Lima nowadays. You’ll also enjoy the mix of blackjack, roulette and poker, including more niche variants like Oasis Poker.

Fiesta Casino

And last but not least, probably the only Vegas-style casino in all of Peru. Even though it’s much smaller than the majestic Caesar’s Palace, it does a fantastic job of ‘bottling’ the Sin City experience and presenting it with a Peruvian twist. Fiesta Casino is probably the best place to go for low-stakes poker tournaments.

If you’re looking for other table games, then you have French and American roulette, Caribbean poker, Midi punto banco, and other treats waiting for you. As for food and entertainment, there’s a live sports-watching area, several bars and restaurants, and a constant stream of karaoke shows and concerts. It’s Vegas, baby.

Most Famous Gamblers

Gambler icon
  1. Peruvian poker has a lot of rising stars, but none of them shine brighter than Yoshiaki Paco. He recently won second place at the WSOP event in Punta del Este, Uruguay. After managing to beat dozens of other players, he earned a spot in the Millionaire Grand Final, featuring just 15 of the original 450 entrants. After hours of back-and-forth gameplay against Roberto Piazza, Paco finally met his match but went home about $150,000 richer.
  2. When it comes to all-time rankings, there’s no doubt that Diego Ventura is the best Peruvian poker player ever. He earned over $1.5 million from live games, including a jaw-dropping $900,000 prize at the 2015 PokerStars Caribbean Adventure. The very next year, he placed 237th out of over 6,000 players at the 2016 WSOP Main Event. However, Diego’s strong suit is definitely online play, where he earned a total of $8.2 million over the course of his career.
  3. Martín Carnero is another Peruvian poker legend that deserves to be mentioned. Albeit much younger than Diego Ventura, he’s very close to the $1 million mark in career earnings. And just like Yoshiaki Paco, he made a name for himself with strong performances at high-stakes tournaments. Just recently, Carnero took home 5th place at the Lucky Hearts Open event in Hollywood, along with a cool $237,000.

Fun Facts

  • According to an estimate from early 2022, the Peruvian online gambling industry moves over 2.5 billion sol on a yearly basis.

  • Since 2008, there have been a total of five attempts to regulate online casinos in Peru. However, they all failed because Congress was too strict when it came to licensing rules and taxation.

  • Many people in the iGaming industry consider Peru to be one of the markets of the future. This is mainly because of the country’s sky-high rate of internet adoption, which increased by 13.4% just from 2020 and 2021. That’s over 2.4 million new people who could potentially become players.

  • Even in 2016, Peru was already the second-largest gambling nation on the continent, despite not even having a regulated online casino market. Their gross gaming revenue of 2.6 billion sol that year put them behind only Argentina.

  • Offshore online casinos are legally allowed to accept Peruvian players and aren’t subject to taxation as long as they’re not officially registered or licensed in Peru.

  • Peruvian players just barely escaped having to pay taxes on winnings. The removal of the ISC from the draft bill was confirmed by Silvia Monteza Facho, the president of the Peruvian Congress’ Economic Commission, in the summer of 2022.

  • According to Minister Roberto Sánchez, MINCETUR estimates that the Peruvian state will earn approx. 160 million sol yearly, just from taxes alone.

FAQ

Yes, playing at online casinos in Peru is completely legal. It has been this way since 2008, when the government defined this form of gambling for the first time. However, a new law was passed in 2022, which further formalized the iGaming industry and implemented a series of regulations to make everything much safer. Still, it’s legal to access offshore sites, but you won’t get protection from the DGJCMT.

Peruvians have access to a variety of international payment methods, but they love local providers the most. Companies such as PagoEfectivo, KasNet and Tambo are by far the most popular since players in Peru prefer cash payments. However, digital banking methods, mainly Yape and other mobile-based services, are growing in popularity, too.

All online casinos in Peru are regulated and overseen by the Dirección General de Juegos de Casino y Máquinas Tragamonedas (DGJCMT). In addition to approving new license applications and monitoring the work of existing licensees, they also have the power to fine, banish and suggest legal prosecution when necessary. Compared to other LatAm regulators, they’re amongst the most reputable and most reasonable.

Certainly. Peruvian online casinos offer tables from the likes of Evolution, Pragmatic Play, Ezugi and other big software developers. Ezugi even has a lobby with Spanish-speaking dealers just for Peruvians – Gaming Bar Studio Perú. It includes various popular games, and is just one example of how eager companies are to enter the Peruvian market.

The most popular games at Peruvian online casinos include slots, blackjack, roulette, baccarat and poker. However, you’ll encounter a lot of niche games, too, such as keno, slingo or scratch cards. Of course, the best sites will also include variants and novel concepts.

Yes, the best Peruvian online casinos always have at least one welcome bonus for new players. It’s often a deposit match, giving you 100% extra the first time you fund your account. Just read the Terms & Conditions, and check if they accept Yape or PagoEfectivo deposits.
