Evolution

The beginnings of legal casinos in Peru can be traced back to 1979. Then, Congress passed a law allowing slots to be installed in hotels. Even though they didn’t actually legalize land-based casinos, the state showed its true intentions through this ‘pilot project.’ And since Peruvians have always been crazy about gambling, the population wanted even more liberal regulations.

Thus, in 1991, the situation was further consolidated, and in February, the first actual gambling venue was opened in Lima. Unfortunately, 1992 brought forth new legislation, along with a significant tax hike – venue owners were now forced to pay 20% of their net profits in taxes, compared to the 3% requirement that existed before.

Expectedly, this sparked a wave of revolt and dissatisfaction. This, in turn, led to a long-standing legal battle, which only ended in the Constitutional Court in 2006. The players ultimately won, forcing the government to change the law once again.

However, new technologies were looming, and Peru didn’t want to be left behind once again. In 2008, Congress officially legalized online gambling and started giving out licenses. Betsson was the first licensee, but even great news like this couldn’t distract players from one big problem – a lack of regulation. Something had to change.

Current State

Despite Peru being ahead of the rest in terms of iGaming regulations, nobody was truly happy. Everyone knew that Congress had to pass a new law sooner or later, whether it was the players, the operators or the government.

Thus, Bill 31557 came into existence in mid-2022. Throughout the summer, many drafts were suggested. Congress rejected most of them, mainly due to player taxation and other financial issues. However, November 2022 saw MINCETUR finally release the bill.

It defined online casinos and gave DGJCMT the duty to hand out licenses to any interested applicants. Overall, this was seen as a victory by all sides, mainly by the players. They loved that offshore casinos remained legal, further expanding the market. In addition, foreign operators are exempt from paying taxes as long as they don’t have an official Peruvian branch.

Are You Required to Pay Taxes on Winnings?

No, you are not required to pay taxes on winnings from online casinos in Peru. However, this wasn’t always the case, as the Peruvian Tax Code defined this as taxable income. It was 30% for a long time, discouraging players from playing and companies from applying for a license. This rate was amended multiple times since its enactment until it was completely scratched.

The situation was quite uncertain until August 12, 2022, when Congress passed Law No. 31557. It officially absolved both Peruvians and foreigners from paying taxes on their winnings. But it wasn’t all smooth sailing, as some initial drafts included a 1% Selective Consumption Tax (IFC). Fortunately, these suggestions were scratched pretty early on.

As it stands, only operators are taxed by the Superintendencia Nacional de Aduanas y de Administración Tributaria (SUNAT), with the following conditions and rules:

  • All taxes are to be paid monthly, with fines and permanent or temporary banishment as possible punishments.
  • The total tax rate is 12% and is calculated as all income, excluding maintenance expenses (~2%), payouts and previous tax payments (they’re a deductible expense, according to SUNAT)
  • Collected taxes will be distributed as follows: 40% will go to tourism development, 20% to mental health organizations, 20% to sports development projects and 20% to the Public Treasury of Peru.

Nevertheless, there are still some uncertainties surrounding the new law. It also proposed an excise tax on foreign brands that have a registered branch in Peru. Not only is the exact tax rate still unknown, but it won’t involve any online casino that doesn’t have a Peruvian subsidiary.

Various groups, such as the Peruvian Sports Betting Association (APADELA), have criticized this part, claiming it gives an unfair advantage to offshore casinos and betting sites. On the other hand, players welcomed this level of freedom and thought it’ll raise the domestic iGaming market.
